Short answer: An EU distributor considering a wellness capsule should first identify which product rules apply to the exact model and intended use. The EU General Product Safety Regulation (GPSR) provides a consumer-safety framework and a safety net for risks not covered by more specific EU product legislation. A CE logo or a supplier’s generic “EU compliant” statement does not, by itself, document the equipment’s safety, traceability or route to market. A buyer needs the legal manufacturer, the EU-based responsible operator where required, model-specific records and a plan for responding to safety problems.
What the EU sources actually say
The European Commission’s July 2023 GPSR factsheet says Regulation (EU) 2023/988 has applied from 13 December 2024. It explains that the regulation strengthens responsibilities across the supply chain, addresses offline and online sales, and requires an EU-based responsible person for products within its scope. It also highlights better consumer communication, accident reporting and recall notices. These are general consumer-product principles, not a capsule-specific certification or an approval of any model.
The Commission’s separate manufacturer guidance explains another important distinction. Where CE-marking legislation applies, the manufacturer must identify the relevant EU legislation, assess conformity, assemble technical documentation and issue an EU declaration of conformity before affixing the mark. More than one regulation or directive may apply to the same product. The page also says manufacturers must not put a CE mark on products outside legislation that provides for it. In other words, neither “GPSR” nor “CE” should be used as a catch-all label without a documented scope assessment.
A practical purchasing file
Start with the model identifier, electrical configuration, intended users and every claim the seller proposes for the capsule. Ask who is the legal manufacturer, who imports or distributes it in the EU, and who performs any applicable responsible-person tasks. Match those names across the offer, product label, instructions and supporting records. Request the declaration of conformity for applicable CE-marking legislation, the relevant test and risk-assessment evidence, user warnings, service instructions and a means of identifying affected units if a fault emerges. Ask how complaints will reach the responsible company and how customers would be contacted for a corrective action.
The file should also address the operating context. A staffed wellness centre needs clear installation, cleaning, inspection and user-assistance procedures, while an online consumer sale raises additional questions about the completeness and visibility of product and safety information. A private-label arrangement needs a written allocation of responsibility; changing the brand on a housing does not make the underlying technical records or after-sales duties disappear. These are diligence questions inferred from the Commission’s framework, not a claim that every capsule has identical technical or legal requirements.
Limits and next decision
The Commission factsheet is dated 2023 and describes an existing framework; it is not fresh 2026 news. The exact application of the GPSR and any more specific electrical, electromagnetic, environmental or medical-device rules depends on the actual product and claims. The cited pages do not state that a particular TUOKE capsule is certified, CE-marked or approved in the EU, and this article makes no such assertion. Buyers should seek a model-specific review from qualified EU product-compliance advisers and check current national requirements for the intended destination and use. Regulatory guidance is not a substitute for legal advice.
